Terms of Use
- This Terms of Use Agreement (hereinafter – the Agreement) is a public offer in accordance with Article 435 of the Civil Code of the Russian Federation and defines the conditions for using materials and services posted on the website https://gutendata.de/ (hereinafter – the Site), between IP Sosnin Artem Timurovich (hereinafter – the Operator, the Site Administrator) and any individual or legal entity using the Site (hereinafter – the User).
- This Agreement, concluded by acceptance of this offer, does not require bilateral signing and is valid in electronic form.
- In accordance with Article 438 of the Civil Code of the Russian Federation, unconditional acceptance (acceptance) of the terms of this Agreement is considered the fact of using the Site by the User in any way and in any form, including:
- viewing materials posted on the Site;
- using any information and materials posted on the Site.
- By starting to use the Site, the User is considered to have accepted the terms of the Agreement in full, without any reservations or exceptions. If the User disagrees with any terms of the Agreement, they are not entitled to use the Site and must leave it.
- The Operator has the right to unilaterally change the terms of the Agreement at any time. Changes take effect from the moment the new version of the Agreement is posted on the Site. The User undertakes to independently familiarise themselves with the current version of the Agreement.
- This Agreement is based on the requirements of Russian legislation (Civil Code of the Russian Federation). At the same time, the Operator recognises and respects the general principles of legal regulation of relations with users, including those set out in international practices, to the extent applicable to users from other jurisdictions. The Operator ensures that the rights of users are protected in accordance with the applicable law.
- The Site is created to inform Users about the Operator's services, as well as to provide access to information and materials posted on the Site.
- The Site does not contain feedback forms, registration forms, or text input fields. The Operator does not collect or store personal data of Users (full name, phone numbers, email addresses) through the Site.
- Use of the Site is provided free of charge.
- The User has the right to:
- use the Site and available services, familiarise themselves with the Content of the Site without restrictions;
- ask questions related to the Operator's services using the contacts listed on the Site.
- The User undertakes to:
- not use the Site and its content for any purposes prohibited by the legislation of the Russian Federation;
- not disrupt the proper functioning of the Site;
- not perform unauthorised access to the functions of the Site;
- not use automated means to access, copy, or track the content of the Site.
- The Operator has the right to:
- change the rules for using the Site and the content of the Site;
- restrict access to the Site in case of violation by the User of the terms of this Agreement.
- The Operator undertakes to:
- ensure the availability of the Site, except in cases of maintenance and force majeure;
- take reasonable measures to protect the Site from unauthorised access.
- All content of the Site (texts, graphic images, illustrations, videos, audio, design, structure, trademarks, logos, computer programs, and databases) is the intellectual property of the Operator and is protected by the legislation of the Russian Federation.
- Any use of the Site materials, including copying, reproduction, processing, or distribution, is not allowed without the prior written consent of the Operator.
- Quoting the Site materials is permitted to the extent objectively necessary for the purpose of quotation, with a mandatory reference to the Site.
- The Operator is not responsible for the User visiting and using external resources, links to which may be contained on the Site.
- The Operator does not guarantee that the Site will function continuously, quickly, reliably, and without errors.
- The Operator is not liable for any losses, direct or indirect, arising from the use or inability to use the Site.
- All disputes arising from this Agreement or related to it shall be resolved in accordance with the applicable legislation of the Russian Federation.
